A person that wishes to use creative work which they did not create themselves should ascertain who the creator of such work is. They should then contact the creator and relay to him/her their interest in using the creator's design, for what purpose (commercial/non-profit) it will be used, how it will be used, the time period it will be used and if recognition may be given or not. Some form of contract must be drafted stipulating the before mentioned criteria and must be signed by both the user and creator before such design may be used.

FNB should directly contact Asanda (@Sizani) to formally request permission to use her image. They should acknowledge her as the creator and offer appropriate compensation or credit, which could include a licensing fee or public acknowledgement. Transparency is key; FNB should explain how they intend to use the image and for how long. If they cannot reach an agreement, they should refrain from using the image. This demonstrates respect for intellectual property and fosters good creator relations.

What @FNB did was wrong and criminating against one's rights, they should've seek for permission before doing so and if Asanda wants to take legal actions she can do so for they really violated her right to privacy and ownership.

So before using anyone else's work or image it's better to ask for permission on the owner or someone given authority over the work. If the work is already public like Google or so when using it it's best to give credit to the owner

Asanda's tweet suggests that FNB used her design without permission. To avoid similar situations, here's what @FNB or anyone else should do to obtain permission to use someone else's work:

# Obtaining Permission to Use Someone Else's Work
1. *Identify the Creator*: Research and identify the original creator of the work, in this case, Asanda Sizani.
2. *Reach Out and Ask*: Contact the creator directly via email, social media, or phone to request permission to use their work.
3. *Provide Context*: Explain how you intend to use the work, including the purpose, audience, and any potential modifications.
4. *Offer Attribution*: Offer to provide attribution to the creator, such as crediting them in a caption or providing a link to their work.
5. *Negotiate Terms*: If necessary, negotiate terms for using the work, such as payment or licensing fees.
6. *Get Written Permission*: Obtain written permission or a licensing agreement that outlines the terms of use.
7. *Respect the Creator's Decision*: If the creator declines or doesn't respond, respect their decision and explore alternative options.

By following these steps, @FNB and others can ensure they obtain proper permission to use someone else's work, avoiding potential copyright infringement and maintaining a positive reputation.

Re: Activity: Copyright Forum

@FNB should first reach out to Sizani, the creator of the image, to ask for permission to use the work. This involves contacting Sizani, explaining how the image will be used, and discussing terms such as compensation or crediting. If necessary, they should draft a written agreement or contract that outlines the terms of use, ensuring both parties are clear about the rights and expectations. Respecting intellectual property and obtaining permission before using someone else’s work is crucial to avoid legal issues and maintain ethical practices in content creation and sharing.

Based on the scenario, here's what I think @FNB should do:

1. *Acknowledge and Respond*: @FNB should promptly respond to Asanda's tweet, acknowledging her concern and showing willingness to resolve the issue.
2. *Verify Ownership*: @FNB should verify that Asanda is indeed the creator and owner of the image in question.
3. *Request Permission*: @FNB should request permission from Asanda to use her image, providing clear details on how they intend to use it (e.g., promotional materials, social media, website).
4. *Offer Compensation*: Depending on the intended use and value of the image, @FNB should consider offering fair compensation to Asanda for using her work.
5. *Provide Attribution*: If permission is granted, @FNB should provide proper attribution to Asanda as the creator of the image, wherever it is used.

For anyone wanting to use someone else's work, here are some general guidelines:

1. *Conduct a Rights Search*: Research the image or work to determine its origin and ownership.
2. *Contact the Creator*: Reach out to the creator or owner of the work to request permission to use it.
3. *Negotiate Terms*: Discuss and agree on the terms of use, including any compensation or attribution requirements.
4. *Respect Intellectual Property*: Always respect the intellectual property rights of creators and adhere to copyright laws and regulations.

By following these steps, individuals and organizations can ensure they obtain proper permission to use someone else's work, avoiding potential copyright infringement and maintaining a positive reputation.

To avoid similar situations, @FNB should establish a clearance process to ensure they obtain necessary permissions before using external creative work. This includes researching the image's origin, contacting the creator, and negotiating usage rights. Transparency, respect, and fair compensation are key to resolving this issue and maintaining a positive reputation.

If @FNB wants to use Sizani’s image—or anyone else’s creative work—they should do the right thing by getting proper permission.

1. Reach out to the creator – First, they should confirm that Sizani is the original designer and contact her directly.

2. Ask for permission – A simple request goes a long way. They should explain how they’d like to use the image and respect her decision.

3. Discuss fair terms – Whether it’s payment, credit, or specific conditions, both sides should agree on how the image will be used.

4. Get it in writing – A formal agreement helps protect both parties and ensures there are no misunderstandings.

5. Give credit where it’s due – If Sizani wants recognition, @FNB should make sure she gets it.

Respecting creators isn’t just about following the law—it’s about valuing their work and building trust.
